Antares Bermuda (“we”, “us”, “our”) is committed to protecting the privacy of our clients, website visitors and other individuals we interact with. This Privacy Notice explains what personal information we collect, how we use it, who we share it with and the choices and rights available to you.

Antares Bermuda is the Bermuda practice of PKF Antares (Canada), providing audit,assurance and advisory services to businesses operating in and from Bermuda.

We may update these contact details on our website from time to time.

This Notice applies to:

  • Visitors to our website
  • Prospective, current and former clients
  • Individuals whose information we receive in connection with providing professional services (for example, employees, directors, shareholders, policyholders, customers or suppliers of our clients)

It does not cover the websites or services of other firms in the PKF network or any other third-party websites you may access via links from our site. Those sites have their own privacy notices.

The personal information we collect will depend on how you interact with us. Typically, it may include:

  • Business contact details (email, phone number, address)
  • Organisation/employer name

We collect personal information in a number of ways, including:

  • From our clients – where your information forms part of the records we review or process while delivering professional services.
  • From third parties – such as public registers, business information providers, regulators or other professional advisers.
  • Automatically – when you visit our website, through cookies and similar technologies that capture limited technical and usage data.

Where you provide information about another individual (for example, an employee or director), you are responsible for ensuring that you have a lawful basis to share that information and that the individual has been informed about our use of it, including by referring them to this Notice.
We use personal information for purposes such as:

    • Performing audit, assurance, advisory and related services under our engagement with clients
    • Managing our client relationships, including communication, billing and collections
  • Legal, regulatory and risk management
    • Complying with applicable laws, regulations, professional standards and guidance (including PIPA)
    • Conducting conflict checks, anti-money laundering and other compliance checks o Responding to regulatory requests, investigations or legal proceedings
  • Operating and improving our business
    • Managing our internal operations, IT systems and security
    • Monitoring and improving our website, services and user experience
    • Conducting analysis and reporting to support business planning and risk management
  • Marketing and relationship management
    • Sending insights, event invitations and updates about our services where permitted
    • Managing preferences and opt-outs for marketing communications

We will only use personal information in a manner that is lawful, fair and reasonable, and only for purposes that are compatible with the purposes for which it was collected, as required by PIPA.

Under PIPA, we must have a lawful and reasonable basis to use personal information. Depending on the context, this may include:

  • The use is necessary to perform a contract with you or our client
  • The use is necessary to comply with legal or regulatory obligations
  • The use is necessary in the legitimate interests of our business or our clients, and is not unfair or unreasonable
  • You have given consent, where required (for example, certain types of marketing or sensitive personal information)

 

We may update this Cookie Policy from time to time, for example if we change the cookies we use or if legal or regulatory requirements change. When we do, we will update the “Last updated” date at the top of this page. In some cases, we may also highlight changes on the site, for example through a notice or updated cookie banner.

We may share personal information with:
  • PKF Antares (Canada) – where we need to draw on specific expertise, resources or systems to deliver services to you
  • Other professional advisers or service providers – such as law firms, consultants, IT and cloud service providers, and other firms we work with on engagements
  • Regulators, authorities and professional bodies – where required by law, regulation, professional standards or in the course of inspections and reviews
  • Third parties involved in a transaction – such as counterparties, investors or other parties, where our work relates to deals or corporate activity and disclosure is appropriate

We do not sell personal information to third parties. Where we share personal information with third parties, we require them to protect it and to use it only for the purposes for which it was provided.

Because we work with clients and colleagues in different jurisdictions, personal information may be transferred outside Bermuda, including to Canada or other countries where PKF Antares or our service providers operate.

Some of these countries may not have the same level of data protection as Bermuda. When we transfer personal information internationally, we will take appropriate steps to protect it, such as:

  • Using contractual protections or other safeguards where required
  • Limiting access to those who need the information for the purposes described in this Notice
  • Applying our internal policies and procedures to ensure compliance with PIPA and other applicable laws

 

We keep personal information only for as long as necessary to fulfil the purposes for which it was collected, including:

  • Providing our services and managing our relationship with you or our client
  • Meeting legal, regulatory, accounting or reporting requirements
  • Establishing, exercising or defending legal claims

When determining retention periods, we consider the nature and sensitivity of the information, the potential risk of harm from unauthorised use or disclosure, and our legal and professional obligations.
We use a range of technical and organisational measures to protect personal information from loss, misuse, unauthorised access, alteration or disclosure. These may include:
  • Access controls and role-based permissions
  • Secure systems, encryption and monitoring
  • Staff training and awareness on privacy and information security
  • Physical security measures at our offices

However, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security, but we work to protect personal information in line with our legal and professional obligations.
PIPA gives individuals certain rights in relation to their personal information. Subject to certain conditions and exceptions, you may have the right to:

  • Access the personal information we hold about you
  • Be informed about how your personal information has been or is being used
  • Know the types of third parties to whom your personal information has been disclosed
  • Request correction of inaccuracies or omissions in your personal information
  • Request that we stop using your personal information for certain purposes, including direct marketing
  • Request deletion or destruction of personal information that is no longer required for the purposes of its use
  • Be informed of certain personal information breaches
  • Make a complaint to the Office of the Privacy Commissioner (PrivCom) in Bermuda
